The Observation of Blockchain from the Perspective of Cyber Security Law

摘要从网络安全法的角度观察,相较于互联网,区块链的分布式账本等技术及其应用具有更高的网络安全性,并正在采取新的技术措施加强其安全性。然而,区块链技术和应用并非绝对安全,技术与法治耦合保障区块链安全就成为亟待解决的问题。为此,应当从网络安全战略的高度重视区块链的安全应用,从"零信任安全"的理念构建区块链的安全架构和法治保障体系,在区别私有链、联盟链及公有链的技术特性和区分区块链技术安全与应用安全的基础上解决区块链产生的特殊网络安全法律问题,运用网络安全法律手段促进和保障区块链技术和产业的创新发展,在政策、标准、规则及机制等方面推进区块链安全的国际合作,践行网络空间人类命运共同体理念。
From the perspective of the Network Security Law,compared with the Internet,blockchain’s innovative technologies and their applications,such as distributed ledger,have a higher level of network security.With more technical measures adopted,the security of blockchain would be further strengthened.However,blockchain technology and its applications are not absolutely secure;hence,the coupling of technology and law to ensure blockchain security has become an urgent issue.Therefore,we should attach great importance to the security application of blockchain,build a system of blockchain security to guarantee the rule by law with the idea of"zero trust security",solve blockchain’s legal security issues respectively based on the characteristics of private chain,alliance chain and public chain,use legal methods to facilitate the innovation of blockchain technology,promote international cooperation in policies,standards,rules and mechanisms,and put the concept of a community of shared future of mankind in cyberspace into practice.
